Flow Sudoku — Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Flow Sudoku, you agree to these Terms. If you do not agree, do not use the App.

2. Description of Service

Flow Sudoku is a productivity and focus app that combines Sudoku puzzles with a Pomodoro timer. The App helps users build a daily flow ritual through structured focus sessions. The App is available on macOS and iPadOS.

The App offers:

• Free tier: Limited daily sessions and Pomodoro cycles
• Studio tier: Unlimited usage via subscription (monthly or yearly) with a 7-day free trial

3. Scope of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

This license allows the App to be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing, where applicable.

You may not:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Use the App for any illegal or unauthorized purpose

4. Account Registration

Account creation is optional. You may use the App as a guest with local-only data. If you create an account:

• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activity under your account
• You may delete your account at any time through the App or by contacting us

5. Subscriptions and In-App Purchases

5.1 Studio Subscription

The Studio tier is available through in-app purchase. Subscriptions are:

• Processed by Apple
• Subject to Apple's payment terms and App Store policies
• Auto-renewable unless cancelled at least 24 hours before the end of the current period
• Charged to your Apple ID account at confirmation of purchase

5.2 Free Trial

A 7-day free trial may be offered for new subscribers. At the end of the trial, you will be charged unless you cancel before the trial ends. You can manage and cancel your subscription in your Apple ID account settings.

5.3 Cancellation and Refunds

• Cancellation: Cancel anytime in Settings > [Your Name] > Subscriptions
• Refunds: Refund requests are handled by Apple. Contact Apple Support for refund inquiries.
• We do not process payments directly and cannot issue refunds

5.4 Price Changes

We may change subscription prices. Price changes will apply to subsequent renewal periods. You will be notified of any price change before it takes effect.

6. Acceptable Use

You agree not to:

• Use the App in violation of any applicable law
• Use the App to harm, harass, or abuse others
• Attempt to gain unauthorized access to the App, our systems, or other users' accounts
• Interfere with or disrupt the App or its servers
• Use automated means (bots, scripts) to access the App without permission

We reserve the right to suspend or terminate your access for violation of these Terms.

7. Intellectual Property

The App, including its design, code, graphics, and content, is owned by us and protected by copyright and other intellectual property laws. You do not acquire any ownership rights by using the App.

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) paid for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim
• We are not liable for any failure or delay due to circumstances beyond our reasonable control

We, not Apple, are responsible for addressing any claims relating to the App or your possession and use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App or violation of these Terms.

11. Termination

You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms.

Upon termination:

• Your right to use the App ceases immediately
• Subscriptions must be cancelled separately through Apple
• Account deletion may be requested as described in our Privacy Policy

12. Legal Compliance

You represent and warrant that:

• You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
• You are not listed on any U.S. Government list of prohibited or restricted parties

13. Third-Party Terms

When using the App, you must comply with applicable third-party terms of agreement. For example, if you use the App over a cellular network, you must not be in violation of your wireless data service agreement.

The App uses services provided by Apple, Google, PostHog, and Supabase. Their respective terms and privacy policies apply to those services.

14. Third-Party Beneficiary

You and we acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

15. Maintenance and Support

We are solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer operates, without regard to its conflict of law provisions.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms at https://flowsudo.co/terms
• Updating the "Last Updated" date above
• Sending an email if you have an account (for significant changes)

Your continued use of the App after changes constitutes acceptance of the updated Terms.

18. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.
